TERMS OF SERVICE

These Terms are a legal agreement between you (“User”) and EiP Game Studio (in these documents known as “EiP” or “we”). The Terms set out how you may use the website https://eipgames.com/, our apps or any games, products and forums (may be as well known as “Services”) we may offer.

These terms were last updated on the 20th of February 2023.

1) Who is EiP?

EiP is a software company registered in Brazil, CNPJ 47.565.154/0001-94, whose specialty is developing games for mobile devices.

2) Why should you read the Terms of Service?

You should read these Terms because they contain our legal commitments to you (our user) and a list of things you can/must/should do or can´t/must not/shouldn´t do when you use our Services.

Please read these Terms carefully, since by installing, using or otherwise accessing our Service, you automatically agree to these Terms of Service.

If you do not agree to these Terms of Service, do not install our games, use or otherwise access any of our Services.

We reinforce that all our Services are acting according to all the principles of the international law.

3) Can we change the Terms of Service?

At any time, we can amend, change, modify, add, or remove portions of these Terms of Service, its Privacy Policy, and other policies.

If at any time you do not agree with our Terms of Service or any other policies, rules, and codes, we reserve the right to terminate your license, therefore you must stop using our Services immediately.

4) Eligibility and Registration

To use our Services, you must be at least 13 (thirteen) years old (or any other minimum age as is applicable in the jurisdiction you live in). In addition, if you are at least 13 (thirteen) years old and is underage, in other words, not an adult in your country jurisdiction, you must ask your legal guardians to read and accept these Terms of Service for you and create your Game Account.

As a minor, your legal guardians are responsible for all the actions of the user while using our Services.

If you are a legal entity or is willing to use our Services for commercial purpose, you may not create an account in any of our platforms or Services.

5) How do you create an in-game account?

By playing our games, automatically, we create an in-game account to you linked to your, already created, App Store or Google Play account. Furthermore, please note that every one of our games require a different in-game account.

6) How do you close your in-game account?

If at any moment you wish to close your in-game account, please contact use through support@eipgames.com. Furthermore, by requesting to close your game account you should immediately stop using the game related to that account, because if you log in again we will understand that you dropped that request and still want to play the referred game.

Please note that if you log in again after your account has been deleted, we will automatically create you a new in-game account that will not contain any progress/save of your previous account.

7) What do I need to do with my log-in details?

f you register for our Services and are not logging in through a third-party service, you need to keep all your information safe, such as username, e-mail address and password. In addition, the user is responsible to keep the confidentiality of all the data mentioned above, as well for all the activities that are held under the user account.

If you are logging through a third-party service, we recommend you read their Terms of Services.

Your account, including username and password are confidential data, so you shall not share those information’s with others. Therefore, if we believe that your account is being used by more than one person, interfering in the fair gameplay, we reserve the right to suspend, terminate or cease to support your account without liability. We reserve all available legal rights and remedies to prevent unauthorized use of our Services, such as technological barriers, IP mapping and a direct contact with your Internet Service Provider (ISP).

Because of the amount of people using our Services, it´s not liable for us to check the identities of all users and to know if your login is being used by someone else. Therefore, if you have the knowledge of some unauthorized activity, you should notify us as soon as possible at support@eipgames.com.

8) About the License:

As soon you agree with these terms, and any other agreement presented by a third-party, such as App Store we grant you a personal license to download, install and use our Services, through an App Store, for your personal entertainment.

You agree that the granted license is personal, non-transferable, nonexclusive and non-sublicensable.

As a user you may be able to create “your own” content (“User Content”), like a video for example. When you submit or transfer your User Content you need to act according to all of our rules, including, but not limited, to our Privacy Policy, thereby, we reserve the right to, at any time, strike your “User Content” without any notice. Furthermore, you grant EiP a non-revocable, worldwide, royalty-free, license to use and/or distribute your User Content. You grant EiP as well the right to use, as we please, your User Content in any promotional materials and marketing content to promote our Services, therefore, you waive any moral rights you may have to your User Content.

Can we limit your Access to our Services based on where you live?

Yes. Depending on where you are located, we may limit, restrict or modify your access to part of our Services or even to all of them, such as Virtual Goods and some items inside our games.

Can you purchase or obtain a promotion code or key that may be used in our Services?

Yes. We may offer you codes that can be used in our Services that may grant you some discount in our game stores. The codes can be offered by EiP through one of our platforms or by an authorized Third Party.

Please note that we do not authorize any Third party to sell any of our codes or keys, therefore, if you do purchase from an unauthorized party, EiP WILL NOT be responsible for any refund.

9) License Restrictions:

To access and use our services you agree to follow the rules listed and mentioned on this present document.

Therefore, you agree not to:

  • Post, distribute, make available or send any data, text message, graphic or computer file that can be understood in any way as a violation of any applicable law or violation. Thereby is forbidden any kind of offensive, sexist, racist, bullies, stalks, harassment, vulgar, obscene, or sexually explicit language or images.
  • Use your License commercially, or for any promotional purpose.
  • Use, or provide, any unauthorized third-party programs that intercepts, emulates or redirect any communication between the Services provided by EiP and the user, or that collect information about one of our Services.
  • Use, or provide services to anyone, that are not offered within the Services by us (or the functionality of the App Store), such as hacks, bots, cheats or third-party software that may interfere with our Services or online and network play.
  • Access or use our Services on more than one device at the same time.
  • Copy, reproduce, distribute and display, any of our trademarked and patent or any other intellectual property if they are not expressly authorized in these Terms or as permitted by applicable law.
  • Sell, transfer, rent, or distribute any of the Services offered by EiP, such as Virtual Goods or Game Currency, including participating in or operating “secondary markets” for our Services.
  • Attempt to reverse engineer, derive or copy source code from, modify, adapt, datamine, decompile, or make derivative works based upon code from the Services or content offered by EiP.
  • Circumvent in any way any technological measure we implement to protect our intellectual property.
  • Develop, distribute or use any software to gain unfair advantage in our Services, such as game modes, Virtual Goods and Virtual currencies.
  • Attempt to breach, scan or test security or authentication measures provided by ours Services.
  • Access, tamper with or use any private information from our Services or other users.
  • Interfere or attempt to interfere with the access, network, or any Service we provide to users.
  • Collect, or attempt to collect, access or store any information that’s not from your account, may it be from our servers and Services or from other users.
  • Trespass, or attempt to gain access to servers and Services provided by EiP without explicit permission.
  • Impersonate or misrepresent your affiliation with any person or entity.
  • Use IP proxying or other methods to disguise your current location, for any purposes.
  • Play on another user’s account or share an account with another user.
  • Use the Services in any way that would affect or reflect negatively on us or the Services we provide.
  • Encourage or enable anyone to do any of the foregoing.

If you disrespect in any way the rules you agreed on follow as a user, we reserve the right to banish your account temporally or permanently. In these circumstances we can remove any of the virtual items you gained playing or buying through our Services. Besides, as a user that violate the rules, you are not entitled to any refund or compensation of the removed items.

In addition, if you violate any law, we are entitled to cooperate with any authorities reveling you user identification in our Services. Therefore, you, as user, state that you are not listed as a restricted parties, located in any territory that is subject to a United State Government embargo or that has been classified as a country that supports terrorist.

10) Who owns the information and content available through our Services?

All the information and content available in any of our Services are owned or licensed by EiP and as well protected by Law.

In view of the above, you are not allowed to change, modify, or decompile in any way any of the Services EiP provide. Therefore, we may have a software programed to detect any cheating activity in each one of our Services, collecting information from your game account or any program thar may be connected with cheating.

We defined cheating as any behavior or actions that go against the intended rules and objectives of our Services, giving an unfair advantage to the player or altering the normal gameplay experience. This can include, but is not limited to, the use of hacks, cheats, mods, bots, or any third-party software that manipulates the game or provides an advantage over other players. Cheating can also include exploiting glitches or bugs in our Services, manipulating the in-game economy, or engaging in any other activity that is deemed unfair or contrary to the spirit of the game.

11) Virtual Goods, Game Currency, or any other item we may “sell” in our Services:

Purchasing or Gaining Virtual Goods and Game Currency: We may offer in our Services options to buy virtual goods with real world currency, or with game currency, depending on the item you choose.

What kind of items the user can purchase?

Inside our games you can find in our store, but not limited to, characters skins, vehicles, vehicles mods, items that may improve your game experience, gears, digital cards, boosters, game play consumables and season pass.

What you need to know when you purchase some of the items in our games?

When you purchase one of the items in our store, listed above, you, as a user, agreeing with these terms, understand that the purchase is made through the App Store or any other platform we make available to you. Therefore, you should read and understand all the agreements related to the purchase, even if the agreement is on App Store or other platform, we may make available to the user.

EiP does not process any payments, so you need to be aware that if you have any issue or problem with the purchase related to payment, you should contact immediately the third-party that provides the transaction, such as Apple or Google Play Store.

Can EiP limit the purchases?

Yes. We reserve the right to limits the number of times the user can purchase any of the items available in our stores.

Can the user transfer Virtual Goods and Game Currency to one game to another or to other users?

The virtual goods and game currency that you may find in one of our games and Services are not transferable to another Services and games that we may have/offer.

After you agree with all the Terms presented by us and with App Store agreement, we will grant you a personal and non-transferable license to use Virtual Goods or Game Currency in or games (you will only get some of the items through purchases). Any trade of Virtual Goods or Game Currency between the users will be know as a fraudulent activity, thereby we reserve the right to cancel or revoke the use of the Virtual Goods and/or Game Currency of the user.

Virtual Goods and Game Currency have any monetary value?

No. None of the items we offer in our store or game currency have any monetary value, therefore, they are not transferable, tradable, or used for any investment purposes.

Can EiP modify in any way the Game Currency or/and Virtual Goods in the games?

Yes, except in case the law forbids, we reserve the right to, at any moment, without previous notice, replace, change, replace or even cancel/erase any or all Game Currency and/or Virtual Goods.

Therefore, you agree to not bring any claim against EiP or any of our employees, directors or anyone that is part of EiP team, related to Game Currency or/and Virtual Goods.

What you need to know about refunds:

Aside from when the law says otherwise, all Game Currency and Virtual Goods are not redeemable or refundable, except if any of the items purchased have any kind of “bug” making them unavailable (according to the specifications provided by us).

Furthermore, some other jurisdictions provide to users a statutory right to terminate the contract/transaction (accepted by making the transaction to buy Game Currency or/and Virtual Goods) of the digital items purchased within a period called “cooling-off”, without any legal repercussions.

Thus, by purchasing any Game Currency or/and Virtual Goods during the “cooling-off” period, you hereby relinquish any statutory right that gives you the right to terminate the transaction, therefore you will not be eligible to receive any refunds.

However, if the applicable law does not authorise you to relinquish your right, you agree that this right will expires as soon you use the items you purchase in any of our game.

12) What is Apple Store and/or Google Play Store responsible for?

If our game (downloaded by you from App Store) does not meets its warranties, and if you paid to download, App Store will be responsible to refund you to the maximum value permitted by law.

Except for the case mentioned above, App Store will not be responsible to any other claims. Therefore, App Store has no obligation to provide any game support and an eventual investigation (such as offence of intellectual property rights). As beneficiaries of these Terms, App Store have the right to enforce these Terms against you.

13) Third Party Websites and Resources:

The Services we provide may contain some links and advertising content of third parties that we are not responsible or have any control about it. Thereby, because you are dealing with a third party, you assume any risk involved by visiting their website/link.

14) Who is responsible for the Data Charges while using/playing our games?

We are not responsible for any data charges. Thereby, you agree are responsible for any expenses related to data charges, and you may contact your provider in any problem or matters about this subject.

15) What else is EiP not responsible for?

EiP is not responsible for, but not limited to:

  • Guaranteeing that all our Services will be always available to the user without any bug, virus, error, hacks or cheats.
  • Any losses or consequences you may have during the period our Services become unavailable.
  • Any damages to your phone or computer caused by a virus or other software.
  • Any damage or upset you may suffer because of the actions of other user.
  • Any lost of savings, revenue, profits, or data.

Nevertheless, the aforementioned in some areas (countries, states..) may be limited by law, therefore, some of the terms above may not be fully applied to you. Because of that, those limitations will be applied to the maximum extend permitted by the law of the place you are located.

 16) Will any translation be provided?

The original language of our Terms of Service and Privacy Policy is in English. Thereby, you relinquish any right you may have by the law of the country you are located to have these and any other of our Terms written in other languages.
